People still say a person was “thrown clear,” as if leaving the vehicle is what saved them. It almost never is. In a crash, the occupant kept inside a space that holds its shape fares far better than the one thrown out of it. That is the position of the federal safety agency, and it is not close.

Ejection is one of the most injurious things that can happen to a body in a wreck. Once outside, the body meets the pavement, the fixed objects, and sometimes other vehicles, at speed, with nothing left to absorb any of it. Partial ejection can be worse, catching a head or an arm between the vehicle and the ground as the car rolls. The injury literature has tied ejection and entrapment to the most severe outcomes for decades.

The single thing that most stands between an occupant and ejection is the belt. Worn and working, it ties the body to the seat while the vehicle turns. Unworn or failed, little holds a person in place as the car rolls, and the openings that appear in a rollover, the windows and the sprung doors, become exits. That is why “he was not belted” is the beginning of the inquiry, not the end of it. Whether the belt was there, whether it latched, whether it held under load, is a question about the hardware, not only about the person.

A rollover is not one impact. It is a sequence, the roof and the pillars striking the ground again and again while the body inside is loaded from angles a frontal crash never produces. When the roof gives way into the occupant space, the head and the neck are in the path of it. That is why the roof-strength rule exists.

Here is why a trial lawyer cares. Do not let “thrown clear” or “wasn’t wearing a seatbelt” close the file. Ask whether a working belt was available in that seat, whether it latched, whether it spooled out under load. Ask what the roof did, how far it came down, what the vehicle’s roof rating was for that model year. The car keeps the answers in its structure and its restraints, and a salvage yard erases both within weeks. The vehicle is evidence. Preserve it before it is crushed for scrap.

No one is lucky to be thrown from a car. The lucky ones are the people the belt and the roof kept inside a space that held.
